i was working with kec international ltd from Oct 06 to Jan 08 . Now i m working with a PSU . After joining new job in feb 08 i applied for pf transfer in my new account . for that i filled all relevant forms & sent a letter with the help of my PF deptt. for the fund transfer but till date they have not transferred my money..
Kec people called me & asked me to produce site clearance which i could not provide as in a hurry i had to leave the organization i did,t take the clearances. Although i do,t have any dues expect one matter that i could not serve 3 months notice which I was supposed to do. The money is pending with KEC Trustees .
now my question is ..in any case can an employer refuse to pay/transfer employees pf money in my case...
plz help me & give the appropriate solution so that I can get my PF money transferred.

Dear Sir,
No one employer in any case refuse your PF money. If he does, he would be on defaulter. Even PF dept has make a rule that If any employer does not sign on PF withdrawal form of employee, that employee can sign the pf form from any gazetted officer & submit in the pf dept. His claim will be pass.
In your case, there is no any roll of your old employer. Your present employer fill the form & submit in pf dept.

My current employer has already sent a fund transfer form ( perhaps form 13)with all relevant details/documents and a copy to me in july 08. i have the copy of completed form & letter with me also.
in my case pf amount is with KEC PF TRUST not with govt PF/Epf Department .
what should be my next step....
