Dear Mr. Parminder,
Referring to your query, recent amendments and changes have occurred in Labour Laws as follows:
1. FACTORIES ACT - 1948: A lot of changes related to hazardous operations, the appointment of a safety officer, health, safety, welfare provisions, etc., are proposed to be changed in the Draft Notification.
2. INDUSTRIAL DISPUTES ACT - 1947: A workman can directly approach the Labour court or Tribunal in the case of dismissal, discharge, or termination from services without the knowledge of conciliation authorities.
3. PF ACT - 1952: The EDLI benefit limit can be extended from Rs. 1,00,000 to Rs. 1,30,000.
4. ESI ACT - 1948:
- Coverage of employees' wage ceiling extended from Rs. 10,000 to Rs. 15,000.
- Conveyance Allowance excluded from the part of wages.
- Employers must show/maintain records for up to 5 years for inspection. Records older than 5 years need not be shown for inspection. Private educational institutions, hospitals, and dispensaries are also covered under ESI.
5. Workmen Compensation Act:
- Casual labor is also covered.
- The compensation payable for death ranges from a minimum of Rs. 1,20,000 to a maximum of Rs. 4.3 lakhs.
- For permanent disablement, the minimum compensation is Rs. 1,40,000, and the maximum is Rs. 5.2 lakhs.
- Computation of wages for compensation to be extended from Rs. 4,000 to Rs. 8,000. The act is to be known as the Employees' Compensation Act under the new amendment.
6. Payment of Gratuity Act - 1971:
- Contract labor is also eligible for gratuity if they meet the eligibility criteria under section 4, i.e., 5 years of continuous service.
- Compulsory insurance for employees is provided by the employer under the PG Act. The maximum amount payable under gratuity is Rs. 10,00,000.
7. Payment of Bonus Act - 1965:
- The wage ceiling limit can be extended from Rs. 3,500 to Rs. 10,000 per month under section 2(1).
- Computation of wages for bonus extended from Rs. 2,500 to Rs. 3,500 per month.
- The minimum bonus is Rs. 3,500, and the maximum bonus is Rs. 8,400 payable to employees under the provisions of the said act.
8. Minimum Wages Act - 1948: Salaries/wages are disbursed to employees through a bank.
9. Contract Labour (R & A) Act - 1971: If the contractor does not fulfill statutory obligations of PF, ESI, etc., the labor working under the contractor is deemed as employees of the Principal Employer.

The employer has shown/maintained the records up to a period of 5 years for inspection. More than 5 years of records need not be shown for the inspection of ESIC. Kindly send us a copy of the circular for ESIC and for PF as well if any.
