i want to take an opinion of you guys on the following for my friend
she has got an offer from an IT firm for joining as a recruiter but tells that she would have to sign a bond of 2 years .and also apart from signing a bond she has to give a cheque without date of Rs.2.5 lakh as a security with the bond ,if she leaves the company before 2 years that cheque will be encashed otherwise it will be returned to her after completing 2 years.
i have heard before that companies sign the bond and asks to pay the amount if an employee wants to leave before 2 years but is this a new thing in this industry that they ask for a cheque in luie of the security. i mean what is the use of the bond then if they are asking for the cheque.
they might even misue it , so what should she do,any idea as to the cheque should be given or only a bond should be signed.

One's your friend gets the offer letter,get the offer letter and the cheque she is supposed to give the company photo copied and attach a letter to it, in the letter give a standing order to the bank who''s cheque she issued, not to clear the cheque if it comes to them,as the cheque has been provided to the company under undue influence and was not given by your friend with complete and clean consent.
BUT IF THE BANK DON'T AGREE TO HER REQUEST THEN DO NOT JOIN,PRIOR TO DOING AL THIS PLEASE CHECK WITH YOUR FRIENDS BANK TO KNOW IF THEY WOULD COOPERATE OR NOT.
GO FOR NATIONAL BANK,THEY ARE MORE COOPERATIVE.
THINK ON IT,IF FEEL OK PROCEED AHEAD.

thats Bullshit.. Dnt ever fall trap for such a thing. ask them r they giving any guarentee for better job position after 2yrs, or high growth or a high salary. if yes can they assure you the same way.
if someone does not believe in you, then dont evn beleive them.
these sort of companies are spoiling the very essence of HRM.
Be firm, there are a lot of other companies. check out.
also try taking suggestions from people who are already working there, a friend or reference..

Yes they can charge under 138 negotiable instrument act. But this act wont be applicable if you give your company a proper notice stating your reason for resgination.
And still if the company dont relieve you then, the company would be forcing you to forced employment,which is illegal, so you have full right to protect your rights both monetary,social and fundamenta rights from a company who is forcing you to perform something against your will,amounting to a illegal activity.
SO PLAY TACTFULLY NOT EMTIONALLY.

dear seniors,
unfortunately i made this serious mistake of signing a bond along with providing them a security check of 1 lac rupees without dated, in which it was mentioned on 100 Rs non judicial stamp that if i leave the service before 2 years then i will have to pay that 2 lac rupees amount to the company.
they are giving me extra burden and not paying very less as they are taking work from me .. please suggest me that how can i break this security bond at earliest. Even i cannot look for any job as they beat the employees if they found that some is looking for another job.
please help me. i m getting hopeless day by day.
