Hi,
I have undergone a company sponsored certification and i couldn't clear it.
I am aware that if am certified i have to sign an agreement and serve the same. But, now when i have sent my resignation email, my manager is insisting me to sign the agreement which is for 6 months. so that i wont be relieved.
I was never communicated about the service bond when i was writing the certification and nor it is written in any communication received.
When i asked the HR team they says that its a equal responsibility of an employee also to inquire about the agreement before appearing for exam and now need to sign the agreement.
can anyone help me to find a solution to this problem.

Dear mogudamv,

Yes, your organisation should have communicated conditions before sponsoring any kind of certification course. If your HR says that "its a equal responsibility of an employee also to inquire about the agreement before appearing for exam and now need to sign the agreement." then they are just immature. Officials matters are not handled under some assumptions.

However, why you are wary of signing bond for six months? This is not that long period. Do you have any job opportunity at hand? If you have job opportunity and if your organisation does not leave you then you may approach the highest authorities of your organisation. If they still do not release you then you may approach labour officer of your area. You have not written designation. Appropriateness of approaching Labour Officer of your area would depend your designation. If the organisation does not abide with to the verdict by labour officer then send lawyer's notice and finally sue the employer.

However, think ten times before adopting the entire course. What about your future employer? Will they take lightly of some candidate going to court? 99.9% HR do not take on board a candidate who is on litigation course with their employers.

I had a great opportunity to join other organization and they have come up with this service agreement only after the resignation is sent to them. I followed the escalation matrix and reached to VP level. All of them are on the same side and wanted me to sign the agreement and forced to me to sign the agreement, with which i lost my opportunity of joining other organization.
Thought there was no written policy stating that a person has to sign the agreement. I was pushed to do so.
