i have not come accross to any such formula in any acts other than state gazets of the minimum wage where the formula for the computation for overtime wages is given.
i need to learn the practiced system vis-a-vis lawful guideline in this matter.

i have no doubt about the double rate which is mentioned in different laws.
however there is no guideline about the computation of daily wage to which i belief you will agree.
as regard to practice i hope every one is doing as you have said but this forum should approach to appropriate authority in this matter.

the formula what we are using ( total over time hour in the month) suppose 120 hour then 120/8=15 days then basic/days(30 or 31 as per the month)*15days hope this example make you clear

if u go by law the formula for calculating overtime is
(gross salary/26/8*OT hrs)*2
double from the normal rate and as per act u can allow 51 hrs of overitime in a quarter to an employee and esi is to be deducted on this wage.

Each & every Indian labour law concerning OT (Central & States) says that we are to make payment to the worker/employee @ double the ordinary rate of wages/ normal wages. According to me The Factories Act,1948, The Minimum Wages Act,1948 & State Shops & Commercial Establishment Acts provides us procedure for taking OT & for caculating the OT payments. Section 59 of Factories Act says that where a worker works on OT he will be entitled to wages at the rate of twice his ordinary rate of wages. According to Rule 25 of Minimum Wages (Central) Rules,1950 also states that OT is to be given at double the ordinary rate of wages. According to the Minimum Wages Act & Rules we are to divide the rate of wages by 26 for calculating 8 hours (one day) wages. For calculting one hr. wages we are to divide by 8 to one day wages. Thus if we take OT for one hour then we are to paid wages @ double this wages for one hour. State Shops & commercial Establishment Acts also provides provisions for OT payments. You may go through these enactments for having more clarification on the subject.
