Hi,
One of our lady staff (covered under esi) recently undergone a surgery and asking for leave with salary. She is our permanent staff & has been working for 15 years. Will the salary be paid during the leave period by the ESI dept.

Dear ABC,
Your lady staff if cover under ESI she should be claim to direct esi branch office. The authority medical officer will gratned leave as act. Esi leave not given by any employer. For that employee is must present 180 days. So you are requested that told her to conatct ESI dispensary / Local Branch office for benifit.(She must concerded ESI medical officer)

Hi Dear,
If she is covered under ESI then employer is not liable to pay for medical leave, the ESI will grant the number of leave days and also payment. If employer is paying for that then ESI will not as benefit for same cannot be availed from two different sources.
Hope this will help you and kindly guide your employees in a right way so as they avail the maximum benefit designed for them.

She can get the leave benefits from ESI only, not from Employer, if she took leaves through ESI.

In the above said case, she done operation through a private hospital without any notice to ESI dept. Let me know whether she is eligible to claim sickness benefits (reimbursement of medical expenses).

Dear Friends, I have one doubt regarding ESI return. My colleague had taken 10 days leave in Feb 11 which is loss of pay. In return No of days working is 18 or 28. Pl clarify Thnaks Veda
