Dear all,
I am Chandrakant working as hr in bangalore,
One of my employee called me today and asked why he is getting basic
salary less, his basic salary is 1800.
He is saying basic shoulbe be not less than 2300 as per employee laws,
is that true ?
I tried searching the same in employee laws, but i didnt find any
information,
Kindly let me know whether their are any laws such as basic should be
minimum this much.

Hi,

As far as i know minimum Basic is not prescribed statutorily. However, Basic plus DA must not be less than the Minimum Wage applicable to the work as per given schedule.
Ideally, Basic should be 30- 40% of the gross. Keeping the basic too low would deprive the employee from better terminal benefits.

yes there is a law about minimum wages below to that u can't provide the basic salary and it keep on changing from time to time say after every six month it changes.
for that u have to speak to ur labour lawyer about minimum wage becoz it varies from state to state.
As far as haryana is concerned here min basic wage are revised and from july these are Rs. 3510 for unskilled labour.
your employee told to the right thing pls take it seriously otherwise ur company can be in trouble.

There is no law that defines the quantum of basic. All legal requirements on minimum wages and definition of wages normally includes Basic plu DA and there are few other allowances that is constituted as part of wages from Minimum Wages Act perspective.

Hi chandrakant,
You need to check Minimum Wages Act, 1948 to get your solution. Being a central legislation it is applicable to all the states of India.
secondly, in which industry you are ? and accordingly, you need to check under which catogery i.e. skilled, semi skilled or unskilled, the concerned is covered.
as far as minimum basic wages is concerned, there is no such Act governing the minimum basic wages.

Dear Chandrakant,
I also feel your employee drawing less salary.
Pl. refer Minumim Wages act and obtain Min. Wages circular gazete from Labour Commissioner office. Check your employee fall under which skill catagory. Give basic wages applicable to your industry and special allowance applicable to your induestry and his skill level.
Advise your employer to follow & give minimum wages to employees.

Dear Mr. Chadrakant
At the beginning of the financial year ie., in the month of April the State Goverment will revise the Basic & DA, which will be published in the Government Gazette or it can be obtained from the local labour office.
But Basic & DA varies companies to companies.
It is mandatory that all the employees are covered under min wages as per the last revision.
Please take up this issue to your management other wise you will be facing penalty as well as you have to pay with arrears.
