Hello All,I have joined this forum a month ago and was going through all the topics/posts discussed by all the members and gained lots of awareness on most of the topics. However, I got a doubt and would like to get your assistance and opinions.Do we have any limitations to follow the labor laws being a BPO company ? I am working with a company, with a staff of 60 seats in Health Care Industry. Would like to know is there any rule/clause which says BPOs doesn’t fall under labor laws? If yes, under what circumstances we need to get enrolled in order to follow the labor laws?Could some one help me with their inputs?Regards,Avinash

i do not think there is any such labor law that exempts BPOs.
Labor Laws are meant to provide protection to the labors/employees. if a particular industry is exempted from it then it loses the laws lose their meaning. You do the maths - how many companies are there in india that are covered under the BPO industry. And How many people are working in BPO industries.
So what do you think now...?

*The Contract Labour (R&A) ACT, 1970 Annual Return by Principal Employer i.e the BPO Company .

The Payment of Wages ACT, 1936 Annual Return

The Employees Provident Fund ACT, 1952 3A & 6A Annual Individual Returns & Returns of Contributions to the Regional Provident Fund Commissioner.

The Employees State Insurance ACT, 1948 Summary of Contribution

*The Contract Labour (R&A) ACT, 1970 Renewal of License if employing Contractor. .

The Payment of Bonus ACT, 1965 Annual Return

Shops & Establishment Act Renewal & Registration Certificate.

* CLRA compliance will arise if the BPO employees are Leased.If pay rolled by the BPO then it is not relevant.
