The employee has gone on sanctioned leave from 06/04/2010 till 17/04/2010 and thereafter remaining an unauthorised absence since 19/04/2010.
The company had send him the notice of unauthorise leave on 25/05/2010 and further against sent on 18/06/2010 and no correspondence received from the employee upto 28/08/2010.
Now the employee had come and give reason for long leave that his father has met with an serious accident, and asking for the salary and bonus now.
Any body advise wheather we needs to pay him the dues he is asking for or not?
What are the legal actions associated in terms of an employer take and employee take.

Dear Kosh
I have faced a similar situation last month and have sent a show cause notice to employee on his permanent as well as on the residential address and advised him to give us in writing that what was the cause for his unauthorized absence....
In your case as you have sent him the Notice twice and in this i think that this employee has come back just for the Bonus and Salary (in short MONEY)............ as per my knowledge when we provide every employee with the Appointment Letter and get it signed by them, each and every thing or condition is written very clearly that if they will reamin absent for more than 08 days without sanction, then there employment will be cancelled automatically..............
In this case you can state the T & C mentioned in the appointment letter to that employee. I would suggest you not to provide him with the benefits...
