Dear Seniors,
Appointment Order Format for a Non-Employee:
Ours is an FMCG Company, my management want to take a person as "Service Technician” and like to pay him only a consolidated pay, without PF, ESI or any statutory bindings of an Employee.
Please share your valuable suggestions on drafting an appointment order, I don’t want to face any legal or statutory problem because of this.

Prabhu,
You can not issue an appointment order and also escape from statutory liabilities s.a. PF, ESIC etc. Howsoever you draft an appointment order you carry responsibility of compliance. If not done so, you carry a risk of getting sued.
If your company does not want to undertake the statutory bindings of compliance of labour laws, you may outsource the jobs. But again, as a principle employer it is your responsibility to ensure compliance for those employees. And of-course you have to pay for it.
