We are an Engineering Design Solutions Provider Company with the main office, at Bangalore. Our engineers work at our HQ for the clients. We also send engineers onsite as per the client's requirement. We, however, sign the NDAs before going ahead with the purchase order. Nevertheless, we have encountered a problem facing the onsite engineers. Our client/s has been making offers to our engineers, but however, these engineers have refused their offers since they are freshers they have got back to us (not officially though).
I would require help from my friends to frame an NDA which contians the clauses which states that:
1. Disclosing party should not recruit any engineers from the receiving party
2. Should not recruit any engineers from the receiving party, however, could recruit the engineers who have relieved from our servicefor a minimum of 2 years.
I hope I am clear in putting forth this issue. Awaiting your responses and suggestions.
