Is it necessary to fill Form-11 (Revised) even though my present employer is not enrolled/member of EPF scheme? And, I have not been EPF member ever.

Dear Sir,
I am working as a HR Astt. in construction company.
We have 27 drivers in the company & the salary of drivers are Rs.6900/- P.M.
They do not want to contribute the PF from their salary.
My question is that -
Is it necessary to fill the form 11. And if all the drivers are fresher for their job & they have no previous employer & no PF account then how we will fill the Form 11.
Also i want to know that this Form 11, we have to submit to the PF department or it is not required.
Please help me immediately as soon as possible.

Mr.Deepak,
Form 11 is compulsory whether employee has previous pf account or not and form 11 will not submit in pf department.

Thanks Nitin ji, Sir my principal employer is asking for receiving copy of Form 11 duly received by PF deptt. My principal employer is M/s. Hindustan Mittal Energy Limited. Regards, Deepak

Dear Deepak Please submit form 11 to EPF office with covering letter then they will acknowledge the receipt of Form 11 and show to your employer . No wrong in it. Regards, V K Rao

My staff members are fresher & they have no previous employer as well as no previous PF no. But in Form 11 their is a column of previous employer & previous PF number so i want to know that what to mention in that blanks.

I agree with your comment but its just a formality. According to law form 11 is not compulsory to submit in pf department. Form 11 will be attach with employee personal file with signature of employer & employee. No need to submit form 11 in pf deptt.

It is compulsory to fill up Form no 11 for all exempted employee who are not member of the scheme, if they have not joining any establishment in past also, in that case it is mandatory to fill up it and form no 11 is basically an declaration of the employee about his past service, membership etc and it is required to be taken from the employee newly joined an establishment where provisions of EPF and MP act are applicable.
The Form is basically kept by the employer to prove that the employee is an exempted one. In accordance with the provision of the Act, you have no need to submit Form no 11 to the PF Department. Keep the form in personal file of the employee.
