Dear All, Please let me know the procedure to get the claims under WC Act & ESI Act. I joined a company recently. Before my joining, a few of our employees met with an accident and they were not covered under ESIC. Kindly let me know the procedure to get the claims under ESI Act for those who are covered under ESIC.

Dear Ramprasad, the first thing that you, being the HR entity, need to do is to send the IP to the nearest and applicable dispensary, fill up Form No. 16, and remit the same before the regional ESIC office. The medical officer would furnish the fitness certificate to the IP, and the same would be revealed to you as part of the HRD. You need to inform the ESIC office about this entire process.

A certificate of continuous or re-employment would also be awarded; this can be done by filling Form No. 37 (prior intimation to the concerned authority).
