Hi Pramod as per the Gratuity act an employee should complete 5 years of services. so as per your question gratuity is not payable who has complete 4 years and 7 months. thanks Anita

As per amendment in the gratuity act , gratuity in this case is not payable.If an employee has worked for a minimum period of 4 years 240 days , he would have been eligible for gratuity .
on completion of 5th year , if he works for another 6 months , he would become eligible for 6 years full benefit.

As per Act Gratutity Eligibility criteria is Shall be Payable to an employee on termination of his employement after he has rendered continuous service for not lessthan 5 years.Thus For an employee to become entitled for the payment of gratutity,he must have rendered continuous service of atleast 5 years .The completion of continuous service of 5 years is not necessary where the termination of the employement of an employee is due to his death or disablement.
But where an employee has completed 4 years & 240 days of continuous servicein the 5th year he is eligiable for the gratutity.
