Dear Jadish,
It is clearly mentioned in the attached file ie in section 12 of the payment of bonus act that bonus shall be calculated at 3500/-. Section 2(13) is definition of an employee under the said act. Every employee receiving wage not more than Rs.10000/- per month is eligible to get bonus.

Actually there is no fixation of Bonus but as per government rule the company either in profit or loss the bonus @ 8.33% should pay to the employee. In my knowledge various employer is there who are paying bonus equalient to employee salary (if it is Rs. 10000/- or 15000/- per month). In the meantime, a fixation of bonus rule also there i.e. if salary is above Rs. 3500/- per month then the bonus will fix as Rs. 3500/- in place of 8.33% of total salary

When both rules are there i.e. either 8.33% or Rs. 3500/-(fix) the employers will look their own benefit. If, Salary in all (consolidated) is above (no bar) Rs. 3500/-, then employer can fix bonus as Rs. 3500/-. If, consolidated salary below Rs. 3500/- per month then @ 8.33% will effect on such situation.

Dear Jagdish
If a person is getting 10000/-, the bonus limit will be 3500/- for 8.33%, if the Management announces it for 20% Bonus, then you have to add that balance 12.67%, so the payable limit will be 10000/-.
Thanks & Regards
