Can someone please advise, do we need to provide PF if the basic salary is above 6500/-. Our employee strength is 25.
As per our consulatant once a person is covered under PF by any of his ex employer he has to be covered by his present company as well.
Please confirm. Its very urgent.

Thanks a lot for your prompt reply.
So as per what i understand from your mail. We need to be covered under PF regardless of our basic being above 6500/-.
As our company is an MNC, I need to provide required documents to support it. Can you send me the PF act which testifies the above statement.

legally your consultant is correct but we take from employee form 11 which says he was not member earlier and if basic salary is more than 6500 ,he is exempted employee,need not to deduct PF but take form 11 from employee.

Dear Smitha,
Mr. Malik is absolutely right, You can take Declaration from-11 from those employees which declares that they were not PF member earlier. This is the practical approch but if your management wants to go as per statutory compliance then again Mr. Malik is right you have to enroll them.

You can deduct on pf wages is above 6500. but for that you have to take a consent from employee in below format

Dear Sir,

Sub : Granting special permission for deduction of P.F.

You are hereby requested to please grant me the special permission for deduction of the Provident Fund from my PF wages above Rs.6500/- per month w.e.f. _______ and my P.F. A/c. No.
After receiving above constent you have to forward the same with proforma for submitting permission under para 26 (enclosed).
But from employer's 12% share you have to deposite FPF maximum 8.33% of 6500 i.e. Rs. 541/- and balance amount you have to add in 3.67% .
for example : pf wages is Rs. 7000/-
employee's contribution is Rs. 840/-
employer's contribution is Rs. 840/- (epf 3.67% Rs.299/- and FPF Rs. 541/-)

Please note a person whose basic is less than Rs. 6500 is covered under PF included clause whereas if his basic is more than Rs. 6500 he is covered under PF exempted clause where there is a choice to go in for PF but its not mandatory in that case you got to fill in the excluded form.

even employee covered under PF in previous employeer(basic wage < 6500) no need to deduct the PF from his salary(if Basic > 6500) in Current company.if current employeer have any PF policy so we can pay based on 6500(if Basic wage > 6500) .other wise no need to deduct. suppose employee is continued in One company after some years he earned more than 6500 basic wage at that time we must contribute PF amount at least based on 6500 i.e.Rs780/-. if employeer wants to provide based on actual basic wage we can contribute.
