Dear All,
ESI is not covered in our factory area, We covered all the employees under WCA, one of our staff getting 17500/- salary he met with an accident out side the factory after the duty hours. Imdtly. we admitted him to the near by (tie up) hospital. Two months he was on bed rest. We have not paid any salary that person and now the hospital bill including the operation expenses around 20000/- need to pay.
Kindly advise, we as a employer need to pay this bill or the employee?
Can we sanction a loan and deduct from the employee?
Is the Staff employee getting 17500/- is covered under this WCA?
Kindly advise.

The answer of ur first query is NO, if the accident occurs out of course of employment.
There is no stipulated amount of salary is given under WC Act so ur employee is covered under it.
Yes u can sanction a loan and deduct it from his salary.

Dear Vasu ji,
Firstly, your organisation is not covered under ESI as you stated, since your orgnisation not covered you have to do GROUP INSURANCE POLICY for all the
employee (its a benifit scheme to all). By gods grace the accident occured out
of duty hours, if it is on duty......? So you make a WC policy to all the employee
from any nationalised Insurance Company(Ex.United India Insurance co.)

Dear Sir,
One of our staff (Engineer - Salary 16,500) went to to his residence for having a dinner due to non avilability of canteen facility in the company, actully he was performing B Shift (4:00 PM to 12:00 Midnight), after having his dinner and returning to his duties he met with an accident and died immediatley due to head injury.
Kindly advise weather his dependents can get WCA from the company. The Total no. of workmen working in factory are more than 300.
