My friend was working as a Software Engineer in Kerala,after getting a good job in UAE re signed from that firm with one month notice as per the contract.When he was issued offer letter CTC was all with PF contribution from employer,my friend was also putting 1000 rupees as Cutting At the end of job when matters came for final settlement they gave omly amount from his side,is this legal,is he eligible to get the contribution from employer,what we have to do,Please advise me??
Note: Employement duration 1.11 yrs

Hi Suresh, PF amount is not included in F&F. He needs to submit 10C and 19C forms (signed from authorized person from the company) at EPF office to withdraw employee and emplyer contribution.

Dear Satya, Is there any legal provision ,if the employer doesnot make prompt payement,like not getting subscription in EPF office???

I am not aware of the Legal Provisions on this issue. Hope any one from the group can help you in this issue.
Normally employer has to sign the forms and put company seal thats it more than this nothing to do. You need to give the Bank Account details in the forms. Once you submit the form with in 45 days the amount will get credited into the concerned persons account.
There is no provision of employer giving the PF amount directly to the employee(If i am wrong plz correct me). Better ask your friend to check completely.

Hi,
As per the PF Act, you can withdrawal the PF & Pension Fund from the PF Office after submitting From 19 and 10 C duly singed by the the employer.
IN this case, it is shown that the employer is not submiting the PF amount either to PF Office or he has seperate PF Fund.
First of all you have to fill the PF withdrwal forms and submit to your employer.
If they are not submiting the amount into the PF Fund they will refuse to sign the forms. Then write a letter to the PF Commissioner stating the same thing that your Company is deducting the PF from you but not depositing. As a prrof attach your salary slips for 2 - 3 months.
If they sign the Froms, submit it to PF Commissioner Office. The amount will come directly into your Saving account, which you have provided in the Forms.

Since he is in UAE, send form 19 and 10 C to him and ask him to filll the form and sign on it.
Somebody opn his behalf can go and submit the form to his previous employer.
While submitting the Forms and the receiving from them, which will as proof that his Froms has been submitted.
Once you have proof only then you can follow up with them about the status.
