We have a factory located at Kundli Disst. Sonipat Haryana, for which you registered under EPF & ESIC, We are opening another factory at Disst. Gurgaon, Haryana, for that whether we have to take subcode for both EPF & ESIC, OR Our existing code serves the purpose? OR Whether we have to take Sud code of EPF & ESIC for Gurgaon unit? I humbly request you to kindly provide me the procedure and document required for taking ESIC Sub Code for a separate unit located in the same state (State Of Haryana)

1. Sir. kindly intimate following points:-
- Whether new factory at Gurgaon is of the same name with same management viz.-partners, Directors etc.
- Whether the nature of production etc. or activities are same as that of old factory at Kundli,
- Whether the new unit at Gurgaon will be having same financial entity i.e. same books of accounts, same balance sheet etc.with old unit at Kundli as Head Office/Registered Office.
- Whether the area at Gurgaon where the new unit has been established or is being set-up is implemented area so far as applicability of ESI Act is concerned.
2. I feel that in case the answer of above issues is in affirmative, it will be most appropriate if you appropach, Sub-Regional Office, ESIC, Gurgaon for issue of Sub-Code for your new unit at Gurgaon.

1. sir, both factory (Gurgaon & Kundli) have same name and management.
2. However both factory have different nature of production.
3. Both factory have same system as far as financial things are concern.
4. ESI Act, is applicable at Gurgaon Factory.

Sir, you have not intimated whether the area in Gurgaon where new unit has been set up is implemented area, if so, you may contact SRO, ESIC, Gurgaon with complete details of the coverage of old unit at Kundli and request them for either issue of fresh Code Number for Gurgaon unit or a sub-code Number as may be decided by them.
2. I may further inform you that in my opinion, in case you will try for sub-code Number, the Unit at Gurgaon will be coverable right from the date you employed 1st person at Gurgaon and contribution from beginning till date will also be payable, if employed. This will also include compliance in respect of all coverable employees including at construction stage, if any. This will depend upon the facts of your case. Therefore, you may discuss the issue personally with the officials and take action accordingly.
