When an employer should release the salary slip to his/her employee? May he/she release the salary slip at the time of the release of salary, and if yes then what will happen if the salary disbursement is delayed due to some reason. What our law says in terms to clarify when an employer is bound to release the salary slip.

In general, wages slips are required to be issued to the employees under Minimum Wages Act, 1948 & the procedure & the format is provided by the applicable Rules. Similarly where Contract Labour ( R&A) Act, 1970 is applicable then wages slips are required to be issued to the workers as per applicable Rules. In general wages slips are required to be issued a day prior to the disbursement of wages. To be more specific you may go through your applicable Act & Rules.

Salary Slip - When one makes payment to other, the details of payment should be specified. If not specified, the choice of alloting the payments to any head rests with receiver. This is under Indian Contract Act. Similarly, if Employer gives details of payment in the salary slip, and Employee accepts it, it is bindig on both. If not, then items like salary advance, wrong or over payment, any other adjujustment will be as decided by the Employee. Employer cannot then say, he does not accept it. Employer did have first opportunity which Employer did not avail, at his peril.
