Dear All, Is that possible we can show that an employee was working on the salary of Rs. 15000, he resigned and again he joined on the salary Rs. 6500.00?

Yes it is possible, for company it would be treat as new employment accordingly term & condition can be new/revised.

Dear Sharma,
Please be careful while you do this. Though this would be treated as fresh employment, but there would be some under currents to this. If the employee who joins back with lesser salary raises a dispute with labour dept that he was coerced to resign and take fresh employment, then the matter would become worse where management would be prosecuted for unfair labour practices.

complete the employee full and final settlement and after 3 month he could join as a new employee in less salary.

Hi,
The decrement in salary could also be a result of decrease in working hours. There could be a possibility that the employee was working full time and was shifted to part time work later on which explains the decreased salary.
It could also be a result of the decrease in job responsibilities.
If the said employee is working for you then you may issue a new letter with reduced working hours. or if he worked for someone else then seek a clear explanation for why it was done that way. Also, you can do a reference check regarding the same.

employing for lesser salary, immediately to last working day, can be disputed at a later date. Hence, you need to give break for atleast 6 to 12 weeks and employ with new terms and conditions and offer. other wise for the purpose of avoiding payment of PF and statutory covers, case is manipulated. this type of act give room to non compliance and inspection where you endup with related problems. If the employer is capable of handiling the issue at that time, you may leave matter to him now.

Tachnically, it is possible for any body to rejoin the same company. He may join at the same position /higher position /same department or different department with same condition of employment or with different conditions of employment (such as, on part time /retainer /consultant etc.basis). However, I feel, your query can best be answered if you let us know the following :

1. What was his reason for leaving the job ? Did he resign on his own or was he asked to resign ?

2. Has he been properly relieved and full and final amount credited to his bank account ?

3. After how many days of gap, this rejoining process is happening ?

4. What is the reason for him to rejoin or your Management to consider his rejoining?

5. Did he work some where after leaving your concern ?

6. Has he withdrawn or transferred his PF account to his earlier company where he was employed immedialtely before rejoining your concern ?

7. Has he requested (in writing) your Management for giving him an opportunity for reemployment in your concern ?

I would say no. It is not possible that one accept a job with salary of Rs. 6500 while he was drawing 15000+ in the past but with the situation that actually comes under the extreme condition such as Recession.
If he did that, there might be something definitely wrong done by him or employer... Can you please share more details it or what you know more about him.
Second, if one is working and drawing 15000 or plus and joined again after few days/months of resignation can be offered salary less 15000 but not like 6500 which is even less than half of his past drawing… not acceptable

Though it is possible technically but there has to be concrete reason behind it. You might need to give answer of this in HR Audit or in any govt inspection.
