I'm having this query for one of my cousin, who is working in a one of the company in Mangalore as a Design Engineer. Here, people make you work day and night and at the end of the day, you are left with no pay. If you ask for Salary, they have the response payment is pending from the client.
Situation here is, for asking salary, in fact for asking some money due to emergency, the Boss says you should speak properly with the boss. My cousin, having spoken calmly till then, for no mistake Boss says you are rude. So, he argued with the boss that he was not rude.
After that, he sent a mail to the boss asking for salary. For that he says you are terminated for bad behaviour and if you want to stay, you should send an apology.
Though, my cousin has done nothing wrong, and he wants to quit, should he write an apology letter and what should be the content of apology letter. He wants to write an apology, just for the matter that in the relieving letter, the boss should not give wrong report.

There's no such Payment Date and the payment is pending for past months as well. The reason given for delay in salary is because of the financial status and low revenue. It is a private company started in 2007.

This is a technique used by the boss. By heating up creating worse situation to send out. As per ID act there is no such provisions to send any person by telling \"you have to tell sorry\".
It is advised not to be emotionalized and quit the job. Stay there. No apology. No resignation. Give reply as you have right to ask eligible salary immediately.

1. Spent a lot on the resource to retain duing the off season. The amount invested on the resource will be a loss for them.
2. They dint say you wont get salary, it is just delayed. (For months and months)
3. If he resigns, one month will be considered only after they approving the regisnation. (What if they they approve after a month, one more month notice period has to be served?)
4. The vacancies start from May or June, till then he has to wait...they dont have problem to recruit a new resource for his role (They are not recruiting replacement resource coz they dont have the capacity to pay the salary.)

Dear Simrose, Regarding notice period. It should be counted from the day employee communicates in writing & not from the day it is approved by the management. Mathur

Tell the boss you'll talk to labour department about this. You just cannot not give salary for months and expect staff to tolerate it in the name of "cooperation" or the company losing money spent on training the resource.....is it a training institute? Did you join it for training? It is a job where you work to get paid. It is that simple.

Such unfriendly or rather hostile employee policies and approach is the bane of private sector or un-organized sector employment.
Only a determined implementation of Labour laws and penal action, as well as dogged pursuit of such matters in the Labour Court by the affected employees, can alleviate the malady to some extent.

From your question it appears, it is a small private establishment and don't have any HR policy or what so ever. Writing an apology letter leads to acceptance the mistake even though not done. Even after accepting the apology letter, they may not be interested to in giving a relieving letter. Since it is a private establishment, it is very difficult to fight with them. If you have access to Local office of the Labour department, please seek their help in getting relieving letter.if they are also bribed, getting justice is ruled out.

I agree with you SPRK, that is the reason I was asking my cousin to bend with them and write an apology letter. But then, it's getting over his head now. On submission of resignation letter, they say you will be relieved after JUNE. The reason being, they have retained him during the off season, may be this means on bench and the season begins from JAN to MAY so that they can make use of him. In all this, they are not speaking about the work he has done without taking his payment.
I have suggested him to talk to one of the HR from the companies in his place as his company does not have an HR.
