Dear Colleagues,
Our organization are engaged in operation and maintenance work only of the existing plant and airport terminal also, for this purpose, we have engaged technical personnel there and paying more then Rs6500/- salary.

Our work is just to ensure smooth working of machine, and to resolve the technical problem, if any

Under these conditions, whether, we should go for BOCW registration & deposit cess under BOCW Worker welfare cess Act.

Please advise.

No, if factory Act to the exisiting Plant i suppose it is in operation, is applicable then BOC does not apply. You do not have to register under BOC take care Bye!

Dear Mr. AK Sharma
Please give some more details about your nature of work. Under which act you got registered your establishment. (Factories Act or Shops and Commercial Establishment Act or CL(R&A) Act or Any other acts). In which area your maintenance and Operation function is going on? Where is the registered office for your company?
If you give adequate informations obviously you will get correct guidance from our learned members.

Dear Bhaskar,
Our Organisation accept the work order of operation and maintenance from Private Industry/State Govt/Central Govt and our activities takes tenure between 6 months to 5 years, and therefore, we got labour license from State/Central Govt. authority.

We deployed technical personnel (Permanent employment) not casual staff at particular location and paying salary/wages more then Rs6500/- salary.

Our manpower does not involved in any building or other construction activities.

So, in this condition, whether, we should go for BOCW registration & deposit cess under BOCW Worker welfare cess Act.

Dear Mr. AK Sharma

It is understood from your reply that you have registered your organisation as establishment under CL (R&A) Act and engaged the Contract Labour after obtaining the Labour Licence.

Have you registered your establishment under Shops and Commercial Establishment Act or Factories Act? If so, then you need not to obtain the BOCW Registration.

Which is the work spot?

Are the Operation and maintenance activities carrried out in the Clients location or in your workspot?

If the work/operation/maintenance/manufacturing process is carried out in a covered shelter, then it must be registered under Factories Act. If your Registered office is away from the Operation/Maintenance/Manufacturing place the Registered Office must be Registered under Shops and Commercial Establishment Act. If you registered under Factories Act then you need not to obtain BOCW Registration.

Once you got registered under BOCW Act, then obviously you have to pay the BOCW Welfare Cess and you have to add all your workmen as Beneficiaries under BOCW Act.

Our company is into PEB Construction ( Pr-Engineering Buildings ).
Are we covered under BOCW ? If yes, than please tell me details procedure of the same ( Point wise )
like : How to deposit the Labour Cess and where, which forms are to be filled for the same.
If our total project value is Rs 10 Lacs, than what would be the Cess Amount ?
