Hi,
Can a client of TCS recruit a TCS employee?
I've resigned from TCS and currently serving the notice period. I had some other offers at the time I resigned.
I remember a clause from the overseas deputation agreement - that whilst on deputation I can not accept an offer from any client / competetitor of TCS. Well, does it mean that one can accept offers when they are off from the deputation?
I'm asking this because I've recently getting chased by my client to join them. We were told that there is a contract between TCS and its client for employee retention. But the client manager seems to have no clue of such contracts, which in turn means that this is merely a myth spread across TCS.
I found this offer better than the others and thus I really want to join this one. Could any one please give me some idea what possibility I have?
Also if there is any clause, then who this is for and for how is that valid?

Hi Guruvai,
If there is a written agreement between Tcs and its client, it will be like client cannot hire their employee for certain period of time after his resignation also. Please check about that before you make a decision.

It depends on the country and the client. I am in a similar situation and our Client has a Non- Compete of 6 months.
