If for example the Company due to some misunderstanding wrongly calculates the last working day(the regional office failed to communicate to the Head Office)and the H O has credited 3 monts salary to the account of the employee,Can the company recover now thw excess salary paid...and is there a legal action to take if employer is not ready to pay back.

Most feasible soln. is you talk to employee and request him to return excess money back. It is difficult in to recover money in court bit not impossible. It's org. mistake and if you go to court org. have much to loose (time,money & Goodwill) than emp.
Make a policy that this sort of mistakes do not happen again.

Nearly impossible as it happens only due to negligence and carelessness OR worst, wilful retribution led recovery which will get quashed anyway.
