Dear Sir/mam, Since last 6 years I have been working with a AICTE approved pvt. Management college as assistant professor. I am also selected under college code 28 as per rules and approved by respective affiliating university. Now I have resigned from the college by serving one month notice as per appointment letter.
I have requested my college management for payment of gratuity refering payment of gratuity act. But management refused to pay me the gratuity amount stating that the institution does not have any provision for gratuity.
Kindly guide me how and from where I can seek legal help for the same.

Dear Arun,
If the management is not coming forward to pay your gratuity amount then approach your area labour office for seeking intervention in the matter. Make a complaint to the area Labour Inspector/ Inspector declared under Payment of Gratuity Act, 1972 & if he failed to resolve the matter then file a claim case before the Authority under the PG Act.

Please write to the Dy Commissioner of Labour of your jurisdiction submitting your claim and asking his intervention in the matter. The Dy Commissioner is the competent authority for administering the Gratuity Act. Writing to Labour Inspectors will not help you in securing your eligible gratuity.

Within 30 days you can apply to the controlling authority in Form I (I believe) for recovery of your gratuity. The controlling authority of you city would be from the Labor Office or from the District Collet orate office
