i am newly joined hr Assistant in private co., having around 150 employes. Regarding the salary Calculation my company follows 26 days calculation and they have excluded Weekly off's and they are giving EL after the completion of 240 days. and they've divided only three parts as salary(basic, da, Other allowance) adhering he local minimum wages act.
(example :-
whatever the total days for that month coming we derive the payable days calculation as below for assume a person receving Rs.5000( bp2500,da550,OA1950)
payable days = 26 -(Absent or los of pay) ...................here the Weeklyoff or National holidays and EL days are excluded
Total BP = 2500/26* payable days
if a person joins or left in between in a month
payable days = 26 -(total days present+ELdays+National holidays) ...................here the Weeklyoff or
National holidays and EL days are excluded
Total BP = 2500/26* payable days
if i asks for reasons whatever the rule forgot it, do follow what we maintaining from the begining. here i'm not justfied. hence i would like to know that the above said calculations were correct or not as per the law?
is any other types of Salary Calculation or types of Leave is there? Please let me know.

Ivanga okkandhu yosippangalo? The salary calculation for any employee is done for 30 days. For every Mon-Sat worked he gets a paid weekly off on sunday. so every month as per Rule, other than 4 weekly Sundays, he is entitled for 1 CL and 1 SL.
In a year he has 12 CL, 12 SL, 12EL, 12 Holidays (Festival+National). For every month worked he earns 1 EL. the accumulated 12 EL is credited to his leave balance at the end of one year of his service. To this list of 48 add 52 Sundays also. 100 paid holidays/ leave days. Ohoh.. hahaha... the employer's blood would boil.
Calculating only 26 days is unheard of for a salaried employee. This would be possible for the daily wage employee or vendor's employee.
By this way the employer is able to save the PF/ESI contribution payable to every employee. The situation of the present day employers is feary and they want to make money within the possible time. Kaliyuga... They will be ready and daring to do anything out of greed.
Elavarasan, better look out for a good company where rules and acts are followed atleast to a decent level of acceptance.

Dear Friend,
Yes you are right any employee can avail his/ her EL After completion of calendar Year and calculation should be on pro-rata basis.
EL- Calculated on certain parameters fixed under the statute, whichever is applicable for you. EL calculated if any employee working continously in the organisation atleast 240 days. if you have excluded your weekly offs then it goes around 318 days of the year.
There are so many things we need to clarify at the time of EL calculation.

As per TN Shop & Establishment Act. the following are followed.
1 CL and 1 SL allowed every month.
After successful completion of a year of service, 12 PL is credited to his leave quota.
Other than this, the usual weekly offs and list of holidays are applicable.
For married female, 12 weeks (6 wks before & 6 weeks after delivery) maternity leave (3 months) is a must at the time of delivery.
Other than this nothing special in leave allotment. This is the base. Some companies try to reframe this rule and change it for their convenience. It is upto the Labour Inspector of the respective zone to accept it or reject at the time of inspection.
This book is available with C.Seetharaman & Co., Anna Nagar (Asiad colony), T.Nagar, or Royapettah (Ajantha).
