If the old employer mentions that the candidate was investigated for a POSH case & found guilty in his reliving letter, then can this come under employment verification & how will it affect the joining in a new place?

Certainly YES. An employee found guilty of any misconduct, let it be minor or major including sexual harassment, the same will be reflected in the background verification and if revealed in such verification will any employer hire him? If the employer does not care for that, what is the sense in conducting background verification????

Now, writing all such things about misconducts in which the employee was found guilty or involved in the relieving order is not fair and we do not do so. This is because the HR ethics say that while issuing a relieving order, we should not put any comments which may cause stigma to the employee.

Hi, It is not a common practice to mention those comments in relieving letter. However during BGV your ex-employer for sure will mention the happening in the Remarks column.

Now a days it is common to include a question like " had the employee been involved in any misconduct? " or "employee found guilty of any misconduct" in the background verification questionnaire and the employer cannot skip it or give a wrong answer.

Very simple, NOT TO GET INVOLVED IN ANY MISCONDUCT.

You should understand one thing, just like we don't make any negative comments on a deceased even if he is so notorious, no employer will write any negative comment about an employee leaving unless there was no such things that had hurt the employer and the team. If the employer has written that the employee was involved in some misconduct, the misconduct should be a major misconduct. Though it is common to mention everything in background verification, the employer will write it in the relieving letter only if it is very severe. The employer is constrained to write such negative things. Therefore, at least when leaving the company, he should beg to excuse him from all that he did in the past and beg not to spoil his career. That is the sole remedy.
