we are an integrated steel plant employing operators . Is it mandatory for them to have licences/certificates. If so it must be from whom?. If any accident takes place in the company premises, what type of legal problems will we face if these operators dont have the licences.

It is mandatory to have the licence since these crane / fork lift needs special skills to be operated and if wrongly used it cause a huge damage as well as death to the working employees.
Today in many mfg. companies, the crane and forklift operators are given mostly by the third party or the contractors.
Due to man power problem / scarcity contractors hire the person who don't have licence and give training. but instruct the drivers to get the licence soon.
But, If any accident happens the employees is treated under ESI and enquiry will be done by the company, If death happens the principal employer is liable to pay the compensation to the employee family which will be recovered from the contractors.
It is the responsibility of the contract Cell / HR , contractors / principal employer to ensure only the valid licence holder should drive the vehicles
