hello, i am working in a pvt ltd company i just want to ask
is there any legal action can be taken against company that they take work from their employers more than 8 hours my office time should be 9 to 5 but no one can never leave office before 7 pm ,10 hours are minimum working hours here and they do not pay for overtime that ,even it is a firm where 200+ worker are doing job and min working hours are 10 and max goes upto 15-20 and they do not pay for that pls help me in this case i am sick of it not only me all of the employer who working in that company please help me what i can do for this please tell me where i can complaint against this

Please complain in writing to Government Labour Officer of your area. In order to complain you will need documentary evidence. If you don't have it you can request the GLO to visit & take statements about working hours from few employees, if possible name them.

Dear Suspense,
From your post it seems you are not eating food and or availing lunch break during working hours.
8 hrs. are actual working hours. If you are availing tea breaks, lunch break than you have to add these hours to your total working time.
Workout that first and then complaint to Labour Officer.

Hi,
It is just to advise that No company make the employee to work for extra hours. If at all extra hours are performed then company pays Over time.There has to be some strong evidences to prove your company wrong. Also companies have administration departments. hr departments who take care of such things. If you have doubts First Please meet the concerned department personnel and clarify your doubts.May be there is communication gap in understanding the Company policies and confusion on issue of work hours. Pls check before you act.

Hi Annonymous !!!
As per Delhi Shops & Est Act, the max working hours are 9 hours a day or 48 hours in a week with 30 mins rest interval each day.
An employer may require an employee to work overtime subject to max of 54 hours of work in a week & 150 hours of total overtime in a year.
For any work in excess of 9 hours on any day or more than 48 hours in any week, overtime wages are to be paid at the rate double the wages.

Dear ANNONYMOUS,
if you are working more than 48 hours as stated above Means working Monday - Sat then it is Total 50 hours a week, which is definitely a breach of Labour act. If total hours are included in your Lunch and Tea breaks then also it should no beyond 8 hours a day (8 X 6 = 48 hours a week)
Please check what exact situation you falls into then prepare a plan of action whether to escalate it to Labour Office or first communicate it to HR personnel for more clarification.
