Dear All,
I request your suggestion on encashment of Earned leave.
I am leaving my present company and as per our personnel manager, I am not entitled to use EL during the notice period, my earned leave will get lapsed and as per the company policy they will not be encashed either.
I would like to now
1. Whether EL encashment is subject to company rules and policies.
2. Will it be possible to get any help from the law.

AS PER FACTORY ACT AN EMPLOYEES IS ELIGIBLE FOR EL .ON LEAVING THE SERVICE AN EMPLOYEE IS ENTITLED FOR ENCASHMENT OF UNAVAILED EARNED LEAVE SUBJECT TO MAXIMUM OF 30 AS PER SECTION 79 OF FACTORIES ACT 1948.PERSONNEL MANAGER CANNOT REFUSE TO ENCASH THE UNAVAILED EARNED LEAVE
