Again your suggestion is required for my peace of mind.
I recently joined a co. I was send here through a consultancy. Company is good, management is also good. Over all I am happy with the company.
Issue is this that I was told by consultancy( before I attended my very 1st round of interview in the co.) that I will be getting all leave benefits here in this new com. During interview I did not discuss leave point to management as I was already committed by the consultancy.
Recently I came to know that here through out the year only 12 leaves are provided. No PL is applicable to any of the employee.
When I tried to talk to consultancy he talked in a unethical behavior. He said oh my god you are having so many problems u can not get these many leaves in all the co, we are also not getting in our co. any PL etc. etc.
Finally he told me tell me clearly do you want to continue or I will talk to management to replace you.
I just wanted to clarify his mean by all leave benefits to employee which is not here at all ,so could have correct for futures candidates.
I could not think what I should do. I can resolve the issue with the management at my level as now I am part of the co.
But I WANT HIM TO TEACH A LESSON THAT HE SHOULD HAVE NOT TALK TO ME WHETHER I WANT TO CONTINUE OR NOT BECAUSE CO. HAS SELECTED ME ON MY CAPABILITY. HE WAS JUST A MEDIATOR FOR WHICH HE WILL BE PAID.
being an employee of the company I can discuss my points with the Co, who is he he to ask for my decision whether to keep or replace. He just need to clarify on his wrong commitment.
Please suggest me something,
But I wish my reply to consultancy should not effect my relation with the co. as they have been nice to me.
Please Guide me what should I write to him, for his rude manner.

Do not get panic so kindly put a smooth word to your reporting manager as you are in the company. if the consultant has approached the management if not do not discuss with your manager/staff/employees in this regard what ever the consultant says do not bother about it because you are an employee in your company so kindly avoid talking to the consultancy to this regard of the leave related issue with him and put a word saying the work is going fine and avoid talking with him do not expect for a revenge as you are fresher you cannot tackle him let it go a head....

But really felt very bad on his reply that whether I want to continue or he will talk to director to replace me, while he knows he himself has given wrong input.
Any way I also would like to avoid as co. is very good, tell me how I could know whether he has discussed the things to the management or not, other wise he will give wrong feed back to the director about me. Should I talk to management regarding this from front, just to inform what happened between me and him.

Scenario 1 : have you did some illegal activities for dismissing you no right?
Scenario 2 : Your Directors are least bothered to know about your attitude that you expect much leaves in the company or not see one thing humans need more leaves/holidays for the calendar year even your director thinks the same way there is no point to replace you
Be cool and concentrate on your work and get some credentials from management and show much interest as you need to stay as long in this same company.... and rest all will be your history.....Consultant work is to just recruit and replace he does not have rights to replace you at any circumstances even if they have good rapport...All the very best for your Future..

Consultancy role is to scrutinise your suitability for the given position. Such trivial issues shall be taken care at your end while you are negotiating. Did not you read the appointment letter? PL is mandatory and the Company which you have joined is fraud, I presume.

No Ram, We are having only 12 leave throughout the year . They have been following this rule for past 5 years since the co. is started.

See as per factories Act 1948 1 leave * 20 days then it comes 12 Leaves as per rule it's correct but most of our companies give EL=1.5*12 = 18 Days , CL =7 Days and SL who is not eligible for ESI:SL=9
12 Days is the rule but it should be en-cashed yearly once or if leave exceeds more than 75 your company should encash it your company gives very sufficient leaves that's what it is not illegal it dependents on your company policies that's what....
