Dear Sirs,
Greetings..
I am working as Sr.officer (HR/Admin.) in a MNC in power sector. We mainly do construction of power plants. One of our subcontractor is retrenching labours due to less work. And the labours have not completed 240 days work. Than what are the compensation benefits will they get?
Please clarify as I am getting some confusion.

its the contractor part to keep them or remove, as principal employer has less activity in the role of contractor,
principal employer has to look into that minimum wages act is followed or not, ESIC and EPF is paid on time for contract workers, employed through contractor.

If workers are through Subcontractor and are covered under the License taken under the Contract Labour (R&A) Act, 1970, they are just paid the last month wages with OT if any with statutory deductions as provided for. As my knowledge goes, ID Act does not provide for Workers covered under Contract Labour Act.

They haven’t completed one years continuous service.Hence not eligible for retrenchment compensation from their employer.
