Hi, We are having more than 50 labours working in our organisation.40 labours working through the contractor basis.other 10 labours are paid esic & pf. My question is contractor has been given bill for 40 labours - their salary above 25000/-. As per govt rule ESIC & PF Applicable only for more than 20 employees. But Nov month we have paid only for 10 labours. Is it correct or not. If its Wrong what are the details we have to follow.thanks.

The principal employer has to ensure that contractor has paid PF for his workers. Right now with only 10 workers you need not pay PF but proposal to reduce number of workers to 10 is being discussed.

PF can always be paid even if you have 5 workers,but once PF payments start it cannot be stopped. EPF act pays down minimum number of workers once employeed PF becomes mandatory.

Thank You for your kind information.We have PF Amount Paid more than 25employees till Dec 2016.After that we arrange contractors.Now we have paid only 10 employees & Collect wages Bill Copy from contractor for 40employees. May i have to collect any other documents or bill is enough.

Do not bifurcate as our employee and contractor employee if including both there are more than 10 employees then ESI is applicable and if both including more than 20 employees EPF is applicable . once both the acts become applicable even if there are one employee then also it will be applicable.
