in my organisation some employees are not having Gratuity components in their appointment letter. and their service is about to complete 5 years in this company. please give me the detail if they are entitled to avail gratuity from our organisation. how they are entitle if is not proposed at the time of appointment? please brief me.

Dear Ms.Aarti,
If an employee completed 5 yrs completed ( Continues service) with the organisation he / she is eligilble to receive the gratutiy under the payment gratutiy act, 1972.
If you mention as component in your appointment letter or if you donot mention in the appointment letter is immeterial when an act applicable.

dear mr shekhar is very much correct .you can not write the details of approx 35-40 acts applicable to employees.this is statutory provision and employee will get gratuity. tks j s malik

Gratuty is statutory benifit to the employees and the employer is under obligation to pay gratuty to the persons completed 5 yrs of continuous service, irrespective of the appointment letter/ standing orders/ service rules/agreements.
Trainees also eligible for gratuty.

i donot think it is good to intrupt someone in between.query in relation to grastuity was in progress,you can reply on that query if you want ,but it is not good habit to raise question inbetween which does not have any relation with original query.
