We are SS Unit covered under Shop Act .
One of our employee ( has joined just before 2-3 days and she is on probation period for 6 months )has done misconduct -misbehave and abused to seniors.
What action should be taken against the empolyee
Can we give Writen memo/warning?
or directly give the Charge Sheet ?
1) Written Warning
2) EXPLANATION OF DELIQUENT EMPLOYEE
3) SHOW CAUSE NOTICE / CHARGESHEET ISSUED TO THE DELIQUENT EMPLOYEE.
4)EXPLANATION OF DELIQUENT EMPLOYEE
5)EXPLANATION SATISFACTORY – MATTER CLOSED
6)EXPLANATION NOT SATISFACTORY – DOMESTIC ENQUIRY
7)APPOINTMENT OF ENQUIRY OFFICER
8)RECORDING OF ENQUIRY PROCEEDINGS

Hi Shilpa,
You should give her the written memo for misbehaving with seniors, also ask for the justification from her for behaving in such manner in writing. (As Sometime it may happen that she is not at fault but as we are not aware of the fact, we may sue wrong person.). Based on the explanation given by her, if she is at fault, give her the written warning else ask her to send the apology letter to the seniors accepting her mistake.
Give her atleast one chance. If repet in future, you my sue her.

better not to go for a domestic enquiry... speak to the employee, try to understand the whole scenario, go for a counseling session. Talk to seniors and explain the case and if everybody convinced, give employee a chance to submit an appeal and close the case.
