Please let me know how to extend the services of an employee after his/her retirement age of 58. Can this be done with same terms and conditions as regular employee like provision for gratuity, PF, house rent, medical etc.

a.) Get a request letter by the concerned employee requesting for an extension of service.
b.) Get the request letter approved and accpted by the anthorized person on behalf of the organization.
c.) Issue a letter to the concerned employee regarding the acceptance and approval of his/her request letter with the effective date of extension.
Service terms and conditions may remain same as it is an extension and not a renewal or a re-joining.

Gayatri, Kamal said it rightly. Only the EPS portion of his PF will not be there after 58 yrs. Pon

Mr. Pon is right. After 58 years of age employee will start gettiing pension (if eligible) and employer contribution (12%) will go to the PF fund and not to the pension fund.

i would like to know why there is limit of retirement age for the person who have put their heart and soul for the growth of the company. there should be a law where a person can not be retired unless and until he wants.

It applies in Pvt companies if his performance was good and his health was OK. But not in PSUs/Govt sectors where a cap is there. Pon

Age clause is not mentioned in the Gratuity Act 1972. the act is silent on this matter.
At what age an employee should retire (superannuation) is dependent on his employment contract (appointment/offer letter) and varies from oganization to organization.

An employee in my organization has retired. His final settlement dues including gratuity had been settled. He was given fresh appointment once again.
My question is whether he would be entitled to gratuity once again in this fresh appointment on completion of five years?
