I need help on below.
Can a company deny earned leaves to employees for the first year.
That is- the employees will get the earned leaves but they can only avail them from second year onwards. For first year no earned leaves.
Also, for first six months all absence days are unpaid.
Please suggest if this is right?

Hi Buddy,
As per factories Act 1948, for the first year employee will not get earned leave. For working for 240 days in the current year the employee will be eligible for EL in next year. And your company is right

As mentioned by Vijay Kumar the eligibility criteria of earned leave is 240 days of working with the company.

It depends whether ur company is covered under Factories Act? If it is not a factory then, it will depend upon applicable Shops & Establishments Act of the state in which you are operating.

Dear,
The provision for the same shall be governed by Shop & Establishment Act of the state if the company is registered under S&E act or else as per Factory Act.
PL/EL is the leave earned by employees after working for certain number of days as per act. Hence it can't be taken prior hand. Hence when employees can avail these leaves shall be as per act first and then as per company policy.
Also as you said that for the first six months absence days are unpaid......but why? Please note HR uses the term "absent" for unapproved leave. If it is so then your company may be right as per their policy but if in case of approved leave they don't pay for those days then it is wrong. In act there is provision for CL/SL which should be assigned to employees prior hand. So you check out applicability of CL, SL,PL/EL in the act for your state and act accordingly.
Pls note every company should prepare policy keeping the respective acts in mind.

उपार्जित अवकाश ( Earn Leave) का मतलब ही यही है की पहले कमाओ फिर खाओ. ( First earn then avail ) अर्थात कोई भी कर्मचारी अगर किसी भी कैलेंडर वर्ष में २४० दिन कार्य करता है तो -

यदि कर्मचारी वयस्क है तो २० दिन में ०१ छुट्टी मिलेगी और यदि कर्मचारी बालक है तो १५ दिन में ०१ छुट्टी मिलेगी!

२४० दिनों की बाध्यता नहीं है यदि कोई कर्मचारी कैलेंडर वर्ष के बीच में भी नियोजित होता है अर्थात यदि जनवरी के प्रथम दिन नहीं नियोजित होता है तो भी उपार्जित अवकाश ( Earn Leave) का हकदार होगा बशर्ते कर्मचारी ने जिस दिन नियोजन प्राप्त किया है उस दिन से बाकि बचे हुए दिन का 2/३ कार्य किया हो.
