I worked for leading IT firm, was hired in India and then transferred to US. I was laid off in US bcoz of lack projects, i was not given offshore transfer back. I have 6.8 yrs of total experience of which 3.5 yrs in India and close to 3 yrs in the US. Am i eligible for gratuity? Which is paid in India.

If your employment contract is signed in India and the transfer to US was as per requirements of the company, you are eligible to get gratuity as per Payment of Gratuity Act, on your termination of employment. Accordingly you will be getting 15 days statutory salary (Basic +DA, if applicable) for every year of service and fraction of service above six months, subject to a maximum of Rs 10 lakhs.

This thread pertained to 2013. Now the maximum gratuity has changed and it is Rs 20 lakhs as against Rs 10 lakhs in the past. Therefore, please read it as "subject to a maximum of Rs 20 lakhs"
