It depends upon the nature of the misconduct for which punishment was awarded as well as the type of the punishment undergone by the employee together with its operative period. In employment parlance, seniority is the higher status or position of an employee than his/her peers in the existing job based on the seriatim of appointment/length of service in that particular post. It gives him/her precedence over the others next below in respect of protection of employment, promotion and other rewards. But seniority can not be the sole criterion for career advancements like promotion. Seniority of an employee will have consideration in such matters only when other things remain the same or equal. Efficiency in the opinion of the employer and blemishless service always will prevail over seniority. If the punishment awarded is for some technical lapse due to error of judgement not resuting in serious consequences, seniority may be considered. When the period of punishment is concurrent with promotion or grant of increment or if the punishment itself is like that of reduction in seniority or depromotion, initial seniority just before the punishment will be of no worth. So, what is after undergoing the punishment can be determined on case to case basis only.
