Can a white collar employee file complain in labour department against his employer for not paying salary? If yes what is the procedure.

Disputes relating to non payment of wages, delayed payment of wages, wrong deductions made from wages etc are addressed as per provisions of Payment of Wages Act. The said Act like any labour enactment has not defined white collar employee. At the same time, any employee whether he is a workman or manager will come under the scope of Payment of Wages Act if his wages per month does not exceed Rs 24000. Hence if your white collar employee is getting a salary of more than Rs 24000, he cannot get the protection of payment of Wages Act. At the same time, if is salary is less than Rs 24000, he can file a compliant before the appropriate authority (labour department) under the Act.

If this white collar employee is an individual contributor, and not performing any managerial duties, then he / she is a workman and can file a complaint under Industrial Dispute Act to the local labour commissioner, for conciliation.
If the matter is not resolved amicably, he /she then can file a complaint in Labour Court under ID Act.

The non-payment of wages is a violation of Payment of Wages Act. The employees are receiving up to ₹24000/-pm as salary & wages can file complaint before the labour authority (may be collar of white, blue, red & color) . The employees are receiving ₹24001/- and above per month can file case in the court.

Hi,
Different states have made amendment to Payment of Wages Act as per their requirements. Like in Haryana, wage ceiling was removed in 2016 via an amendment and since then any employee any any salary can file a case before labour authorities for recovery of their unpaid salaries. Please check with a person aware of labour laws applicable in Assam.

Hi, again it all depends on his nature of work will be decided whether he is a workman or non-workman. Payment of Wages Act also applies as applicable. Everyone has a right to claim his/her unpaid wages/salary for the work done.
