Dear Sir, Govt. assigns work to XYZ Ltd. On behalf of XYZ Ltd. a partnership firm, ABC does the work. On which ESIC & EPFO applicable.

You need to give full details if you expect a proper answer. else you will get a wrong answer because of assumptions.

But basically, PF and ESIC will be payable by the person who employed the workers. It doesn't to matter to whom the work was given.

In this case the Govt. organization is PE, XYZ is contractor and ABC is sub-contractor. Usually if the manpower in under the pay roll of ABC , they will fulfill all compliances including PF, ESIC etc.

But there are cases when ABC is not organized sub-contractor usually local Sardar, political person etc. e.g. Railway jobs on the track, Civil work etc. when for these type of work sub-contractor will bring labor from road side, not maintaining records properly ............ and also not complying for PF & ESIC. In this type of condition, Contractor will be required to maintain records and to comply labor laws properly based on actual payment documents collecting from Sub-contractor.

I have a relevant query. In this case, if the PE added XYZ as their contractor in EPFO portal, then what would be the compliance XYZ has to follow apart from paying proper EPF deduction?Does it need to get registered under Contractor act?please reply.
