Can a person ,who is an employee of state or central govt perform more than 42 yrs of service if so what will be the method of gratuity calculation whether it will upto 42 yrs of service which is fixed or the full length of service he performed i.e. 43 yrs 8 months. As per rule a govt servant must serve 42 yrs of service i.e. 18 yrs will be the entry point and 60 yrs will be exit point. Kindly help me in this topic.

There is no age limit for payment of gratuity, and government as an employer can nit have contravening rule. Hence the person shall get gratuity on full lenght of his service.

Dear PKC, Pl.check this, if he was a govt. servant he must have been Odisha (Koraput) state govt. employee. If yes, check what Odisha state govt. gratuity rules says about it.

Govt employee who are covered under CCS Conduct rules are not covered under Payment of Gratuity Act, 1972. Govt is having separate rules i.e. Death Cum Retirement Gratuity Rules for calculation of length of service and amount of gratuity. If anyone aggrieved by the calculation of gratuity he may approach first to the administration .
