The maternity Benefits Act does not specify any number of times a woman employee shall avail leave for miscarriage. It is not a deliberate act. Therefore, every time miscarriage happens, the employee should be given 45 days paid leave each. At the same time, miscarriage the causing of which is punishable under the Indian Penal Code will not come under the purview of Miscarriage under Maternity Benefits Act.
