My father recently went to the PF Office to claim his A/c which he has worked from 1980-1988. The section officer said that his account has been claimed. Another officer says part amount has been withdrawn. My father swears that he has not transferred or claimed his amount till now. Can anyone help me on how to proceed further.

Hi Antony, first your father needs to speak to your local EPF commissioner and needs to get the statement, then later he supposed to check with the employers he has worked with for this.. also your father can check the status of EPF fund online.. if you father wud still get the same problem that your EPF fund has been claimed, thereafter your father can take legal action but about this i will let you know later and before that I want you to ask your father to do as i suggested above.

Dear Anil Sir,
1. The status of EPF Online - "Your Account has been marked as In-operative Account. For details please contact respective EPF Office."
2. His Employers have long closed the Tannery/Establishment.
I will ask my father to speak to the Local EPF Commissioner and get back to you Sir.

Dear Antony,
Please do not just visit the EPO and talk to the Commissioner.
You can lodge a written complaint with material evidence copies and the get the office acknowledgement, which will help you to proceed further in this regard.

Dear Sir,
I would like to take your advice oon subject issue. My father was a state govt. employee and got retired in 2009. He got his PF amount in his bank account.
My elder brother some how got his favour and got that money and invested some where without tellin my mother.
Now she does have any money and in trouble.
Can she take any legal action my brother?
Plz tell.
Is ther any way that my mother can take that money in her name.
Plz tell me.

There is not definitive answer to your query.
It depends, is your father alive ? How did he give the money, whether it was a joint account, did he approve or was it without approval, what evidence do you have etc.
You will have to sit with a lawyer and figure out how strong a ground you have against your brother, if at all. In any case, a case filed will have be to under civil law, unless you are able to show criminal breach of trust or a direct fraud. The case will go on for years, so i don't have much hope for your mother for immediate relief.
In any case, if you give all details of the circumstances, a lawyer will be able to tell you where you stand. Remember, to work out how much lawyers fees and other costs will be in the case against what you can recover.

whether i can withdraw my pf amount from my West Bengal ocal office. my pf account based on maharastra and i lived in bengal. my office colleague did not help me for the same.

Hi Antony, This seems to be some serious issue with your father's EPF a/c. no. this is due to the employer who might have done mistake while allotting the EPF numbers to the EPF members, though your father has to register written complaint at local EPF office with attachment of necessary EPF receipts enclosed with it and bank a/c. proof (just to intimate dat no EPF claim is been withdrawn.. moreover interact with company HR on mails so dat his replies can be traced by you..

It is necessary to create doumentary evidence by making correspondence with local PF office, Regional P F commsioner office as well as with employer/s as in the case may be.If your matter get settled well and good. Failing, you can file complaint against P F commsioner in Providebt Fund Tribunal.
