Hi,
I am working with a private firm at a profile of Manager- Retail sales. I joined the company on 17th April 15 and I was asked to take care of BTL activities for the company. Initially, I was asked to work with call center team for few months as things werent organised.
My targets with call center team were same as any other employee of the organisation. Company demanded a conversion percentage of 35%, and I amanged to keep it approx 40%.
Now, because of some internal changes, I was asked to work for a new profile of Institutional sales. My senior asked me to move couple of team and everytime I showed my disinterest. But then, in the month of Aug, he said that my salary is high in comparison to any other employee who is working in call center team. So they asked me to shift to a new profile and to involve in bulk selling. I shifted to the new profile on 14th aug 15 (approx).
I worked at the new profile and my seniors accompanied me for meetings. I have informed them that i will be going my hometown during the leaves company is giving for Raksha Bandhan. I was on leave from 28th Aug to 6th Sept (Company's holiday for 18th, 29th, 30th Aug, 5th & 6th sept), so basically i took my medical leaves for 5 days.
When i joined back on 7th Sept, my senior asked me to resign, stating the financial setbacks of the company and asked me to leave immedietly. I was forcefully asked to resign.
Moreover, it was communiacted that 31st Aug will be considered s my last working date. I requested everybody so many times that i need to serve my notice period for 1 month as per my offer letter. But, they manipulated everything saying, we warned you on 1st aug that 31st aug will be considered as your last day of employment if you do not perform. But such conversation never happened.
Please guide, what i can do about it now.

This is a sad thing to happen.
Now you have two options -either to take up legally or move on with life.
This job is not the only one in the market.The company did'nt want you and had no real idea of how to use your talent and kept shifting you around.
I would take the option of looking around for other jobs.

Dear Welcome.world,

Though you have mentioned sequence of events, what you did not mention is about period of probation. Were you on probation? If yes, then for how many months? Did company communicate to you about conversion from probationer to permanent employee? Your removal depends on these things.

Secondly, it appears that company was not interested in retaining you. "Financial setbacks of the company" could be ploy to remove you. Therefore, we need to know how were your relations with your superior managers?

Possibly your "medical leave" came in your way. Your managers understood easily that your sickness arose exactly when there was great chance to prefix and suffix leave with the close holidays. Your manager might have incensed for not keeping him in trust. You could have told to your reporting manager the real reason for your leave i.e. Raksha Bandhan and then only availed of leave with due authorisation. Your Manager might have construed "medical leave" as playing tricks and it backfired on you!

Why did you give so much importance to Raksha Bandhan so as put into stake your employment itself? You could have waited till you found your feet in the new organisation. Just four months and you went on leave with false reasons. Hardly this is a behaviour of manager.

While you have blamed your management for "misrepresentation" for your removal, how about your "misrepresentation"? Why it should be condoned? Is it not pot calling kettle black?

Anyway, there is no point to cry over spilt milk. I recommend you taking the incident as a lesson of life, earning trust of superiors and telling them the actual reasons of your leave.

Hi,
As per my offer letter,, i was on probation for 3 months. Organisation dont communicate anything to any employee regarding the confirmation. But then i have screen shots of the software that company use, which says i am a confirmed employee since July 2015. And as per the offer letter, if I leave or company want me to leave, there will be notice period of 30 days.
As far as leaves are concerned, I communicated well in advance my superior, over email that i will be going my home town and as i am not keeping well for few days, will visit doctor there.
When i mailed the entire situation to the owner of the company, i got a mail from her end, saying if they communicated to me on 7th sept, i will get a notice period of 1 month. But now the DGM and CEO, is manipulating the whole situation.
Also, they are scolding me and threatening me as i have written mails too her.
Please guide what i can do now.

In fact, its unfortunate & rather embarrasing that some times we get involved in unwated situations, where we have no role to play, due to some internal politics. It seems you have also been made a scapgoat of internal Politics.
Anyhow, as per our thinking you should you should get all your dues settled in an amicable manner. Request them to provide you the experience Certificate. Its of no use to serve an organization, where you don't find job Satisfaction.
Search for another suitable job. Wish you all the success.

Basically, I don't think anyone will accept that you fell sick at the same that the holidays were. You should have actually taken an approval for leave without pay for the period of extra leave you needed. Actually taking leave like this before you have completed one year is always a bad idea.
Once the company has decided they dont want you, then everything else is immaterial. The owner has said you will get a months salary as notice pay. So you will get it. Why should it matter that the manager you were reporting to is threatening you. You don't work for him any more.
