This is a question asked by many of the factory managers and HR managers especially in manufacturing setup. Although Prevention is better than cure and thus maintaining safety standards and following established guidelines help to avoid accidents, Accident can still occur at factory due to unforeseen circumstances. The immediate question that arises to mind is what should I do in case of any accident?
Accidents can of 2 types 1. Non Fatal and 2. Fatal.
A Non fatal Accident means that person has suffered bodily injury which may or may not be severe in nature. A Fatal Accident means an accident that causes some one to die.
In case of Non fatal accident one is advised to take following steps
1. Immediately administer First-Aid to the injured employee
2. Incase of serious accident immediately take the injured employee to nearest ESIC / tie-up hospital.
3. Inform family members / relatives of the injured employee.
4. Immediately inform by telephone, fax, email, telegram or messenger about accident to factory inspector and ESIC branch office / WC commissioner.
5. Incase of Death due to or subsequent to such accident inform office in charge of nearest police station.
6. Take at least 2 witness statements preferably of fellow employees
7. Take photographs of accident site
8. Submit accident report in Form 24 to the Factory Inspector and Form 16 to ESIC Branch Manager (online) within 48 hours.
9. Barricade the Accident Spot and stop the work till the clearance given by the Inspector of factories.
10. Update the Accident Register
11. Submit necessary documents to ESIC like employee’s IP No, TIC, muster roll, and accident register, etc so that the injured employee can get compensation benefit from ESIC.
12. In case the factory is Not falling under ESIC rules then update the WC commissioner and pay compensation to the injured employee as per WC Act, 1923
In case of fatal accident one is advised to take following steps
1. Immediately take the victim employee to nearest ESIC / tie-up hospital.
2. Inform family members / relatives of the injured employee.
3. Immediately inform by telephone, telegram or messenger about accident to factory inspector and ESIC branch office / WC commissioner.
4. Incase of Death due to such accident inform office in charge of nearest police station.
5. Take at least 2 witness statements preferably of fellow employees
6. Take photographs of accident site
7. Submit accident report in Form 24 to the Factory Inspector and Form 16 to ESIC Branch Manager (online) within 24 hours.
8. Barricade the Accident Spot and stop the work till the clearance given by the Inspector of factories.
9. Update the Accident Register
10. Ask Family members/ relative of deceased employee to get at least 5 duplicate copies of death certificates in English as local language certificates are not accepted in many government offices including PF & ESIC. In case death certificate is in local language then get it translated and notarized.
11. Submit necessary documents to ESIC like employee’s IP No, TIC, muster roll, accident register, death certificate and crematorium’s receipt etc so that the victim’s legal heir can get Funeral Expenses and pension benefit (if applicable) from ESIC.
12. In case the factory is Not falling under ESIC rules then update the WC commissioner and pay compensation to the victim’s legal heir as per WC Act, 1923
13. Check gratuity Nomination Form F and pay gratuity benefit to nominee of the deceased employee.
14. Submit PF death claim forms 20 (PF), 10D (Pension) and 5IF (EDLI) along with List of surviving members, death while in service certificate, cancelled cheque, passbook copy of pension account of each claimant including wife and individual children.
15. In case of any group life / group accident insurance scheme from insurance company submit necessary documents and get the insurance claim settled for the family member
16. Remember - Always be polite whenever the family members are approaching you for any help because they lost the earning member of their family and they are in need of your help to get compensated.
