Dear All, In the case of a manufacturing company, it has 3 shifts, out of which two shifts of 8 hours and one shift of 7 hours. Suppose an employee working an 8-hour shift must stay in overtime in a 7-hour shift. How many hours of overtime employee should an employee Please give your opinion

Employee in roster of 8 hours shift is asked to continue the next shift of 7 hours, right? Then obviously, he should get overtime wages for 7 hours only.

But an employee in 7 hours shift is asked to stay even for one hour beyond 7 hours should be paid overtime for that one hour exceeding 7 hours. Here the rule that overtime attracts only when an employee works for more than 8 hours or 48 hours in a week will not apply. It should be the normal shift hours in this case.

In this case the Organization has 3 shift of which two 8 hours shift and one 7 hours shift. Therefore, out of 24 hours in day 8+8+7 = 23 hours are engaged for shift and still one hour is left.

In my first employment at Guest Keen Williams ( GKW, MNC ) - THE SHIFT WAS 5 am to 1.30 p.m including spread over ( 8 hours working hours and 0.5 hour is interval for rest ), 1.30 p.m to 10 p.m another shift when again 8 hours working hours and 0.5 hour interval of rest and night shift was 10 pm to next day 5 pm where 6.5 hours working hours and 0.5 hours interval of rest.

Therefore, in any 3 shift operation where employer is interested to engage people 2 shift as 8 hours working hours and 8.5 hours spread over then automatically night shift will be 6.5 hours working hours and 7 hours spread over.

Now, working for 8 hours shift if the employee will be engaged for night shift as OT it will be 6.5 hours overtime double the rate i.e 6.5 x 2 = 13 hours payment provided the employee is present for whole week. In other case 9th hour will be single hour and 5.5 hours at double the rate i.e. 5.5 x 2 + 1 = 12 hours payment.
