Dear,

I wonder if you could assist me on my issue regarding my last company that I worked for. I was working for a Company since February '13 till March '13 for a period of 2 months as Production Coordinator.

I had signed a bond stating that if I leave the company within 18 months I will have to pay the company an amount of 1 lakh.

I completed my training and later when I started working on the production floor I realized that the position that was offered to me was not really the one given on papers. It was mentioned in the job description that I would manage the floor and report directly to the Manager but that was not the case and I was only checking and replying to client emails to which I spoke to the HR head and my Manager over the phone as I was in the night shift and could not meet them as time difference was the issues here stating that this is the issue with the job, it’s not what is in the job description and to add to it I had another Production Coordinator who was a girl who used to boss over me and I complained about her to my Assistant Manager who I was reporting to and told him about the issue with this girl and with the job role that I have been doing so far which is not what I had joined for to which my AM and Manager said it's your call if you feel that the job is not your venture then it's better you leave the job and look out for something else as even we are re-considering your future in the company

Also as per the contract it was mentioned that I would have rotational shifts which would keep changing from morning to afternoon and then nights and it would keep changing every month. However, after the training I was directly put in night shift and after completing a month, I was again kept in night shift while all other Production Coordinators shifts were changed

Even at the work place there were many issues that were arising. There were few dominating people dominating me and interfering in my work in spite of having a lower position than me just because that person has been in the company for longer duration and is in good books with the top management.

Also before leaving this job I spoke to the HR and informed her about all the problems that I was facing and she clearly mentioned that if I intend to leave this job I could do so and it’s absolutely okay and there should be no problem.

I recently received two letters stating that I owe the company an amount of 1, 40,000 which includes the 1 lakh amount as per the bond signed and the remaining is my one month salary that I got to pay them for not providing a notice period.

Please I wonder if you could assist me in this matter and let me know what needs to be done. I do not want to go through these legal problems as the company itself did not fulfil their agreement. They did not give me the right position as mentioned earlier, they kept me on continuous night shift and also the work atmosphere wasn't good enough. In spite of speaking with the manager and HR, I still received this legal notice.

I would highly appreciate if you could let me know what steps I need to take to have this issue resolved.

Please advice.

Thank You

Hi Sachin,
I advice you not to get worried for this issue. I came across the same case for my brother and I consulted with my lawyer, he simply said it is the formality to be done by employer and there are many people in market ready to work. If the company looses Mr.X obviously there is Mr.Y to replace. So do not worry.

Kumar
