One of my employees has expired due to his health issues on 01.07.2020. But he is absent from his duties from 13.06.2020. We would like to apply his death claim. What is to be mentioned in the Date of Exit??? whether 01.07.2020 or 13.06.2020. if we mention 13.6.2020 is it a valid?? please suggest and explain.

Hi Hanurao,
Are you considering treating his absence from 13.6.20 till 1.7.20 as leave and pay or treat the spell as absent/LWP? Taking a lenient view, if at all there is atleast an oral information that he was not in a position to report for duty, you may consider debitting his leave a/c and settle the matter.
My view is, since he had not applied for any leave for this period till death you may treat the spell as LWP and take on record 1.7.20 as exit and close the matter.
On the other hand, if you will treat the spell as 'resigned or terminated' you will have no records to prove and proceed as per the applicable procedure for closing the issue. This is not approprite.
One more option is to close the matter as 'abscond' as on last attendance marked and terminate him on record and proceed further. With no other record, this is the only choice.

The better option is to treat the exit date as the date of death. Any date prior to it would cast the duty on the employer to justify the exit reason. For instance if it is treated as 13.06.20, he was alive on that day and what reason could be there to terminate him on that date. But as regards 01.07.20, it is self explanatory. As he was absent from 13.06.20 to 01.07.20 you need not pay salary for that period. The theory of relation back ( i.e., to terminate with effect from the last of attending duty) is not applicable in this case.

Dear Member,
EDLI Benefit is Paid only for Death while in Service.Consequently, Date of EXIT should be same as Date of Death.Reason for Leaving:Death.The Employee was on your Rolls at the time of Death.

Mr.Srinath suggested a reasonable option which also will benefit the heirs. However without recording 'no show' since 13.6.20, the fact, how to treat the absence of 17 days to declare "Exit on 1.7.20" is the moot point. Have to deal this or exercise caution/consider implications that would follow have to be examined.

Dear Hanuma,
On your small query (as you said), here is what I say.
The employee is on the roll of the company till the date of this death. There should not be any question on his date of exit. His date of exit is his date of death. The days on which he remained absent due to illness can be adjusted towards his leave in credit.
Your small query has so many big answers.

Hi Hanu rao,
Pl.check your data whether contributions have been regularly paid/remitted to EPF a/c of the deceased employee and that of EPS contributions properly a/c td. A complete statement has to be prepared before hand and necessary forms to be filled & sent to Range EPS office for grant of Family Pension. And also proper Nominations have been filed.
How about the wife of the deceased, she's also eligible for family pension.
